This website is subject to the jurisdiction of the State of Austria and the legal provisions of the European Union. In the following you will find all legally required information about this website, the Terms of Use and, in the next section, the Privacy Policy according to GDPR and ePrivacy Regulation.

2. Subject / Purpose of the Website

This website is intended to present the work of the media owner in the non-commercial portrait photography project “ARTUS.MEN – Young Urban Males” and to inform potential photo models about the contents and conditions of a photo shooting.

3. Note on Content

This website contains classic portraits of men as well as photos and videos of undressed male models. These depictions are of an artistic nature and may show the models also in full frontal nudity.

All of these models were at least 18 years old at the time of the respective shootings.

4. Terms of Use

When visiting the website www.artus.men, the content and data protection information provided on this declaration page should be observed.

In principle, every user is free to visit this website and view the generally accessible content. The provisions of copyright law apply to all content.

All texts, pictures, graphics and videos on this website are subject to copyright.

Any use of these contents (in particular of the photos and videos as well as the names and logos of ARTUS.MEN and ARTUS.PHOTOGRAPHY in the way they are presented) on other websites, internet profiles or news blogs as well as in any print products is prohibited, constitutes copyright infringement and will be prosecuted accordingly.

Apart from the generally accessible content, this website also contains photo and video recordings that are not displayed to anonymous visitors to the site. These exclusive contents are only accessible to those users who have registered as Members of the Project and who have been granted access to its Photo Club accordingly.

To see these photos and videos users can register as Members by simply providing their name and email address.

All contents made available via the aforementioned access are exclusively intended for personal viewing on the ARTUS.MEN website. The copyright regulations apply. No content may be downloaded, copied or otherwise made available offline in order to publish it elsewhere or to use or exploit it in any other way. The login details may not be passed on to third parties.

With the registration as a Member of the project these Terms of Use are accepted.

ARTUS.PHOTOGRAPHY reserves the right to refuse registration requests without giving reasons and to deny access to the content of the ARTUS.MEN website. In case of violation of these terms of use, an existing account can be blocked and the access authorization can be cancelled.

PRIVACY POLICY

In accordance with article 13 of the EU General Data Protection Regulation (GDPR), this privacy policy informs about the processing of personal data on this website.

All data collected in connection with the use of this website is subject to data protection.

2. Visit of the Website

This website can be visited without providing personal data.

2.1 Cookies

This website makes use of so-called cookies. These are small text files that are stored on the user’s device through the browser. They do not cause any damage.

We respect our visitors’ privacy and only use cookies that are necessary to run and protect this website and to serve our visitors and registered users the content that they want and that they are entitled to see. If desired, the user’s own browser settings might be adjusted to control the use of cookies and the processing of data on this page.

We use session cookies to determine the user’s language and geolocation and stored cookies for regular visitors to identify their age verification setting, their membership status and content preferences.

2.2 Website Usage Analysis

On the basis of the legitimate interest in the analysis of the use of the online offer according to art. 6 par. 1 lit. f. GDPR, this website uses Matomo Analytics for  website usage analysis, an on-premise analytic software that focuses on visitor friendly data analysis. No data are transferred to a third party service. All data are processed directly on our servers. We don’t share any data with other websites or services. We don’t cross-track our visitors’ internet usage outside of our domain. To identify our registered users with Matomo, we use cookies.

2.3 Google reCaptcha v3

In Order to protect this website against malicious bots and spam registrations we use the reCaptcha v3 service by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland (“Google”) on registration pages. You will find their privacy policy here and directly within the reCaptcha widget on the respective pages.

3. Personal Data Provided for Contact

There are mainly two different ways to get in touch: by using the online forms for model applications respectively participation proposals or by clicking one of the various links to the profiles and user accounts associated with this website on social networks and short messaging services (messenger services).

3.1 Contacting via social networks and messenger services

The easiest way to get in contact is via the messaging function of the profiles of ARTUS.MEN on Facebook, a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”), Twitter, a service of Twitter Inc, 1355 Market St, Suite 900, San Francisco, CA 94103, USA (“Twitter”), Instagram, a service of Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”), Pinterest, a service of Pinterest Inc., 808 Brannan Street, San Francisco, CA 94103, USA (“Pinterest”) and PlanetRomeo, a service of Romeo B.V., De Ruijterkade 7, 1013 AA Amsterdam, Netherlands (“ROMEO”) or by texting to the accounts of ARTUS.MEN with the short messaging services Messenger, a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”), Snapchat, a service of Snap Inc, 2772 Donald Douglas Loop N, Santa Monica, CA 90405, USA (“Snapchat”) and Telegram, a service of Telegram Messenger Inc., Craigmuir Chambers, Road Town, Tortola D8 VG 1110, Virgin Islands (“Telegram”).

When getting into contact by the above mentioned networks and short message services, the user’s data will be processed by ARTUS.PHOTOGRAPHY in order to handle the contact request and subsequent actions according to art. 6 par. 1 lit. b. and art. 6 par. 1 lit. f. GDPR.

The mentioned networks and services are not integrated into this website through plugins, but are only called up when the links are clicked. No data are automatically transferred to these services until the links are activated. Only when the links are activated will user data be transmitted to the respective providers.

Please refer to the privacy policies of the respective services for information on the type, scope, use and processing of the data transferred when calling up the websites of the respective services: Facebook| Twitter | Instagram | Pinterest | PlanetRomeo | Snapchat | Telegram.

3.2 Contact via the Application Form

In accordance with the legal requirements, the personal data given in the application for a photo shooting will only be processed for the purpose and in the context of the application procedure to become a model. The processing of these data is in accordance with art. 6 par. 1 lit. b. GDPR.

The application as a model requires that applicants provide their specific data for the selection and execution of a particular photo shoot. The personal data required is derived from the specifications of the online Application Form. By submitting the model application, applicants agree to the processing of their data for purposes of the application procedure.

As far as special categories of personal data according to Art. 9 par. 1 GDPR (e.g. health data) are voluntarily communicated in the context of the application procedure, the processing of these data is also executed in accordance with Art. 9 par. 2 lit. b. GDPR.

The collection and processing of the applicants’ personal data provided via the online form is carried out by the form provider JotForm Inc., 111 Pine St. Suite 1815, San Francisco, CA 94111 (“JotForm”), who usually transfers the data to a server in the USA and stores them there.

The data provided by the models can be processed for the purpose of a photo shooting in case of a successful application. Otherwise, if the application is not successful, this data will be deleted. The data will also be deleted if an application is withdrawn, which the applicants are entitled to do at any time. The deletion will take place, except in the case of justified revocation by the applicants, after a period of six months, so that any subsequent questions regarding the application can be answered within this period.

3.3 Contact via the Participation Form

In accordance with the legal requirements, the personal data given in the proposal for participation in the project will only be processed for the purpose and in the context of the proposal procedure to provide voluntary assistance for the project. The processing of these data is in accordance with art. 6 par. 1 lit. b. GDPR.

The proposal as a voluntary helper requires that volunteers provide their specific data for the selection and execution of a particular assistance. The personal data required is derived from the specifications of the online Participation Form. By submitting the participation proposal, applicants agree to the processing of their data for purposes of the proposal procedure.

The collection and processing of the volunteers’ personal data provided via the online form is carried out by the form provider JotForm Inc., 111 Pine St. Suite 1815, San Francisco, CA 94111 (“JotForm”), who usually transfers the data to a server in the USA and stores them there.

The data provided by the volunteers can be processed for the purpose of accepting the participation proposal. Otherwise, if the proposal is not accepted, this data will be deleted. The data will also be deleted if a proposal is withdrawn, which the volunteers are entitled to do at any time. The deletion will take place, except in the case of justified revocation by the volunteers, after a period of six months, so that any subsequent questions regarding the proposal can be answered within this period.

4. Registration as a Member

For the registration as a Member of the project (the requirement to gain access to the restricted contents), the user’s first and last name, the e-mail address as well as the desired password will be collected as mandatory data. This personal data is used to clearly identify the user as the person authorized to use the online service and to provide restricted content. The e-mail address is also used to get in contact with the user should this be necessary. The collection and processing of the data is carried out in accordance with art. 6 par. 1 lit. b GDPR.

5. Integration of Third Party Content

As part of the online offer and based on legitimate interests according to Art. 6 par. 1 lit. f. GDPR this website uses content or service offers from third parties in order to integrate their content and services, e.g. videos.

This always requires that the third party providers of these contents are aware of the IP address of the users, as without the IP address they would not be able to send the contents to their browsers. The IP address is therefore necessary to display this content.

In addition to the above-mentioned application form, which is made available through the online form service JotForm, this website also integrates videos from the platform Vimeo of the provider Vimeo Inc., Legal Department, 555 West 18th Street New York, New York 10011, USA (“Vimeo”).

6. User Rights

Users of this website may have the following rights according to the GDPR:

They can request information about their personal data stored (art. 15 GDPR).
They can demand the correction of inaccurate data as well as the deletion or restriction of their processing (art. 16, 17, 18 GDPR).
They can object to the processing of their data at any time for specific reasons (art. 21 par. 1 GDPR).
They may revoke any consent they have given at any time (art. 7 par. 3 GDPR).
